SIU Terms and Conditions

Welcome to SIU, The UK's Multi Trade Body for Security

Upon applying to become a member of SIU, you agree and acknowledge the following conditions, subject to all members, affiliates, in their entirety. This agreement is contractual and legally binding, and, once accepted, you will be expected to comply with its terms. It is essential that you read the terms and conditions in full before accepting them. In particular, we wanted to draw your attention to the following:

(1) Upon completing an application for membership, subject to approval by SIU and the appropriate fee being received by SIU, the applicant may be entitled to membership of SIU.
(1b) Upon completion of the application process, the membership gives an entitlement to the title of “SIU member”.
(1c) All members are entitled to apply for additional benefits at the discretion of the SIU. The benefits are not an entitlement in accordance with Consumer Rights Act 2015 and not guaranteed. The accessing to the benefits are solely additional extras afforded by SIU on a discretionary basis and subject to SIU’s approval on each request.
(2k) If one or more fundings are granted during your membership, and subsequently, you canceled your membership without full years of paid SIU membership for any reason, in this case, you shall be liable to pay the total of funding grants back in full.
(2j) If you joined SIU with an existing issue and benefited from SIU services for this issue, and subsequently cancelled your membership without full 3 years of paid SIU membership; we reserve the right to charge you with our commercial rates £150 per hour for the services provided plus the cancellation fee of £125. This is to protect SIU and its members from those who may try to abuse the service and goodwill of its workforce.
(2k) If one or more fundings are granted during your membership, and subsequently, you canceled your membership without full years of paid SIU membership for any reason, in this case, you shall be liable to pay the total of funding grants back in full.
(5d) For new members, the qualifying period for all services is 30 days from the date your Security Industry Union Limited membership commences. We reserve the right to make exceptions to this subject to individual applications. For re-joining members who previously held SIU membership in any capacity, the qualifying period for benefits and services is 180 days.

This Agreement is made between the Member and Security Industry Union Limited, a limited company registered company number 07051660, and having a registered office at 308 Trelawney Avenue, Langley, Slough SL3 7UB.

Once an application/member is initiated, implemented, you hereby adhere to these provisions and sign these terms electronically, thus creating a legally binding agreement between the party and SIU.

Definition
“Security Industry United”, “Security Industry Union”, “SIU”, is copyright and trademarked under Security Industry Union Limited (NO. 7051660). All rights reserved. Any such infringement of copyright will be a breach and pursued via civil law.

Security Industry Union is an independent professional body for the security industry personnel in the United Kingdom.

Security Industry Union is an independent corporate entity registered in England & Wales with company number 07051660. SIU; is not an insurance company, solicitors or a ‘trade union’ as described under the Trade Union and Labour Relations (Consolidation) Act 1992.

All Members acknowledge that; SIU not a ‘trade union’ as described under the Trade Union and Labour Relations (Consolidation) Act 1992 and Security Industry Union Limited is an independent corporate entity registered in England & Wales with company number 07051660.

Terms and Conditions

Membership
(1) Upon completing an application for membership, subject to approval by SIU and the appropriate fee being received by SIU, the applicant may be entitled to membership of SIU.
(1b) Upon completion of the application process, the membership gives an entitlement to the title of “SIU member”.
(1c) All members are entitled to apply for additional benefits at the discretion of the SIU. The benefits are not an entitlement in accordance with Consumer Rights Act 2015 and not guaranteed. The accessing to the benefits are solely additional extras afforded by SIU on a discretionary basis and subject to SIU’s approval on each request.
(1d) Services, including access to the member’s area will not commence until the application has been processed and payment received by SIU, and acknowledged so.
(1e) SIU reserves all right to discontinue/change/amend benefits without prior notice.
(1f) SIU shall not be liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in the services nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning or use of services rendered by SIU. Any liability SIU shall, in any event, be limited to the membership fee.
(1g) SIU and members warrant that they are coherent under the Data Protection Act 1998 in respect of the membership and information given by SIU. Each party will comply with the Act including but not limited to its obligations in respect of any personal data which it may supply to or receive from the other party.
(1h) Members shall not disclose to any third party information or material relating to SIU, without the written permission of the other party. This provision shall not, however, apply to information or material which is, or becomes, public knowledge by means other than by breach by a party to this clause.
(1i) Any existing issues or issues that may arise in the future which are originated from a period when the Member did not have valid SIU membership shall not be covered under SIU’s discretionary benefit scheme.

Payment
(2) Payment for membership is processed online. This is regulated and adhered to via E-commerce, terms and conditions. Also in accordance with registering with SIU, you are bound and adhere to Electronic Commerce (EC Directive) Regulations 2002 and the EU’s Electronic Commerce Directive 2000.
(2b) Membership is renewed periodically: SIU reserves the right to terminate membership without notice prior to discontinuation of membership. Reoccurring membership payments are the member’s liability and if financial difficulties arise due to lack of payment, SIU holds no responsibility.
(2c) The use of online payment gateways is at the risk of the party, only when payment is transmitted or otherwise within the remit/possession/ care of SIU do we take responsibility.
(2d) Membership is not activated until SIU is in receipt of payment and acknowledged so.
(2e) Discontinuation, impromptu, lack of full payment for membership can result in membership being withdrawn.
(2f) You have the right to cancel your initial registration of membership with us within 14 days of your original purchase providing the service has not been used you will be entitled to a refund of your membership less a pro-rata charge for the period of cover and our discretionary £125 administration charge. This does not apply to subsequent renewals. No refunds shall be made for cancellations after 14 days. Membership cancellations are final and once a membership has been cancelled it cannot be reactivated.
(2g) Refunds will be subject to the return of your SIU Membership card and any other items despatched as part of any promotion within 30 days of your cancellation.
(2h) You will be responsible for the cost of returning your SIU Membership card and any promotional items (if part of the purchase) in an unused condition and in the original packaging.
(2i) Subject to any other statutory rights you may have, we do not provide refunds for any cancellations after the expiry of the cooling off period which is 14 days. If you have used SIU services during this period you will be charged for the services you have used at commercial rates.
(2j) If you joined SIU with an existing issue and benefited from SIU services for this issue, and subsequently cancelled your membership without full 3 years of paid SIU membership; we reserve the right to charge you with our commercial rates £150 per hour for the services provided plus the cancellation fee of £125. This is to protect SIU and its members from those who may try to abuse the service and goodwill of its workforce.
(2k) If one or more fundings are granted during your membership, and subsequently, you canceled your membership without full years of paid SIU membership for any reason, in this case, you shall be liable to pay the total of funding grants back in full.
(2m) If a chargeback application is received, all membership services shall cease for the duration of the dispute.

Usage
(3) Reproduction, duplication or said otherwise of SIU material is prohibited. Service Users found or suspected of such actions will have their membership terminated.
(3b) You may not distribute or commercially exploit content other than with Security Industry Union Limited’s express written permission.
(3c) SIU, nor third parties, holds liability in accordance with the accuracy or performance of additional benefits, conduct or material within the duration of membership.
(3d) Transferring of membership with SIU to another party, company or entirety is prohibited under SIU guidelines and will result in termination of membership for said party.
(3e) Although SIU has made reasonable endeavours to ensure that information contained on our website, third party services, as part of the Service is correct; it is possible that information may be incomplete, contain errors or be out of date. You must verify any information obtained from this site or as part of this Online Service before acting upon it.

Conduct
(4) The Member shall surrender his right to Membership and Membership Benefits should his Membership or any of the associated Membership Benefits be used in conjunction with, to support or otherwise engage in unlawful activity.
(4b) SIU holds the right to terminate membership if parties are found to be discourteous, abusive or disconcerting to members of SIU and staff, without refund.
(4c) SIU accepts no liability for breach arising from a members conduct during the tenure of SIU membership.
(4d) If a member fails to do so or provides false or misleading information, SIU hold reservation to remove membership without prejudice. Members will be liable for breach and remuneration to satisfy said breach.
(4e) The member shall be liable to pay to SIU all reasonable costs, charges or losses sustained or incurred by SIU (including any direct, indirect or consequential losses) that arise directly or indirectly from the member’s conduct.
(4e) SIU members are bound by the SIU Member Code of Conduct during their membership. Any breach to SIU Member Code of Conduct shall forfeit SIU membership and any associated benefits immediately.

Benefits
(5) Benefits are a prospective addition to any membership, upon which SIU remits is not part of the membership package subscription, though can be offered at the discretion of SIU on application. SIU holds the right to remove benefits or services at any time.
(5b) Unless otherwise agreed or specified, any information given by Security Industry Union Limited and its representatives does not constitute legal advice and is given without prejudice.
(5c) Airport Lounge benefit must be pre-booked with SIU and is subject to availability for qualifying members. Fair use policy limits the visits to two unless the unlimited option is offered to Executive Worldwide Members.
(5d) For new members. the qualifying period for all services is 30 days from the date your Security Industry Union Limited membership commences. We reserve the right to make exceptions to this subject to individual applications. For re-joining members who previously held SIU membership in any capacity, the qualifying period for benefits and services is 180 days.
(5e) SIU at their discretion offers various Membership Benefits to its members. SIU reserves the right to change, include, remove, terminate, temporarily suspend, refuse, add, replace, and otherwise vary all Membership Benefits without notice.
(5f) In situations of conflict of interest with SIU on legal or matters otherwise, assistance, aid or remuneration can’t be given.
(5g) If benefits are given, these are upon an advisory and guidance nature, legal advice outside these benefits should be sought, SIU accepts no liability for acting upon advice from an outsourcer/ third party relating to SIU.
(5h) All benefits and services SIU, limited to the UK and where else expressed implicitly.
(5i) If a party to the contract tries to use SIU on a matter that’s pre-existing, initiated before the membership, this is deemed outside of the remit of SIU regulation and remuneration will be sought for the breach, membership will also be terminated.
(5j) When you make a request for an SIU Member Benefit; you are authorising SIU act on behalf of you to process and maintain the benefit during your membership to SIU.

Disclaimer
(6) Unless otherwise agreed the Company shall be entitled to sub-contract all or any part of the work/services of SIU remit.
(6b) The Company will not be liable for any loss or damage suffered by members as a direct result of the Company, its sub-contractors or the list-owner from whom the sample or other service or material is derived being unable to perform services in the way agreed by reason of cause beyond its control including Act of God, accident, war, riot, lockout, strike, flood, fire, power failure, breakdown of plant or machinery, delay in transit, postal delay, or any other unexpected or exceptional cause or circumstance.
(6c) SIU shall not be liable within a civil remit or otherwise, for any loss or damage which:
(i) arises other than through SIU’s negligence or the negligence of its employees, agents or contractors; or
(ii) is not a reasonably foreseeable consequence of SIU’s negligence; or
(iii) is any business loss including loss of revenue or profits or anticipated savings or wasted expense or data being lost or harmed or for any indirect, special or consequential loss or damage of any kind arising from access to or any use of the information and material provided by SIU.
(6d) SIU may offer third-party organisations with recruitment facilities and advertise their jobs, organise training.
(6e) SIU has the right to change the terms of these terms and conditions for on-line services, products and services. We can do so by giving you notice in writing (which may be given on the website) or by sending you a message through the Online Service.

Cancellation
(7) All memberships require a 30 – day notice to cancel and the member will be responsible for any payments owed the SIU during such time. The member may cancel this agreement with 30 days’ notice if you want to cancel, even if your original contract term is up. No refunds will be offered after cooling-off period.
(7b) Any third-party payment disputes shall forfeit SIU membership and any associated benefits immediately. No refunds will be offered.
(7c) The qualifying period for benefits and services for rejoining members who previously held SIU membership in any capacity will be 180 days.

Complaints Procedure
(8) If SIU is seen to not be of satisfactory performance, including that of third parties used during the tenure of membership with SIU: send a written response regarding the situation, detailing the situation with supporting evidence to:

(8b) Our complaints procedure is undertaken only in writing.
(8c) These terms and conditions are for the services and membership of SIU, which are governed by the law and courts of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
(8d) Any existing disputes with SIU shall suspend SIU membership and any associated benefits immediately.
